Members of the Federal Court of Justice visit the Federal Constitutional Court

On 21 November 2022, a delegation of the Federal Court of Justice (Bundesgerichtshof), headed by its President, Ms Bettina Limperg, visited the Federal Constitutional Court for an exchange of thoughts. The members of the delegation were received by President Prof. Dr. Stephan Harbarth, LL.M. (Yale), Vice-President Prof. Dr. Doris König and other members of the Federal Constitutional Court. The topics addressed in the working sessions included the implications of the Federal Constitutional Court’s judgment on the bond-buying programme of the ECB for the German courts and their relation to the courts of the European Union, and the review on the basis of EU fundamental rights of the application by German courts of German legislation that is fully harmonised under EU law. Furthermore, the review of the way the duty of referral is handled by the regular courts of last instance was addressed. Another topic was bias in cases of prior involvement of judges.
